Terms and Conditions

In the following terms and conditions: The Provider relates to Eyes Pie Arts and any practitioner representing Eyes Pie; The Client relates to any nursery, pre-school, school or out-of-school setting accessing Eyes Pie Arts’ services.

  • Class sizes are not to exceed 16 children. This upper limit may be adjusted in consultation with The Client on a setting by setting basis in consideration of space restrictions.
  • The Client is to provide adequate staff for the group according to legal adult:child ratio requirements such that The Provider will not be left in sole care of a group of children, or included in ratios, at any time.
  • The provider’s presence in the setting is only as a freelance artist educator and as such shall not be expected to carry out any toiletting, nappy changing, serving food, provide cover for staff absence or any other child care duties including behaviour management.
  • The Provider will take every possible measure to ensure that lessons are safe for the children and to prevent damage to the premises, including holding public liability insurance.
  • The Provider takes no responsibility for damage caused by children misusing resources e.g. painting/drawing on walls and furnishings.
  • The Client is responsible for ensuring that the children are dressed appropriately for art lessons by providing aprons or asking parents to provide scruffy clothes for their children.
  • The Client is responsible for supplying a range of basic art resources including all consumables – paint, clay, paper, glue. Some “specialist materials” will be supplied by The Provider as necessary for carrying out a planned lesson.
  • Invoices will be issued monthly for regular weekly workshops.
  • Invoices will be issued on-the-day for one off visits and at the end of the week/month for one week/month projects.
  • The Client is requested to pay invoices within 30 days of the date printed on the invoice, unless other arrangements have been agreed.
  • Late payment of invoices (after 60 days from the invoice date for private clients or 30 days for public authorities) will result in interest being charged at a rate of 8% pro-rata in accordance with the late payment of commercial debts legislation 2013. Interest will be charged weekly and new invoices will be issued.
  • After making an agreement for one year or ongoing indefinite lessons The Client will receive up to 46 lessons in a 12 month period.
  • Lessons can be provided from the beginning of the first full week in January until the end of the last full week before Christmas excluding bank holidays.
  • In the event that The Client wishes to cancel a session, they are required to give at least 1 week’s (5 working days) notice. The lesson may then be rescheduled for another day in the same week, if not you will not be charged for this lesson.
  • Sessions cancelled by The Client with less than 1 week’s notice will not be rescheduled.
  • Cancellation of a session by the client with less than 24 hours notice will result in a charge for the lesson and it will not be rescheduled.
  • If a session is cancelled by The Client without notifying The Provider prior to the scheduled start of the session, the full cost of the session will be payable plus any travel expenses incurred by The Provider.
  • Cancellation by The Provider in the case of illness or other emergency: if time allows, this session can be re-scheduled for another day in the same week. If rescheduling is not possible, no charge will be made for this session. Notice of illness will be given as soon as possible and not after 8:30am on the day of a session.
  • The Provider will give at least 28 days’ notice of any planned time out for holidays.
  • As a freelance artist educator, The Provider undertakes occassional work in galleries and museums and may from time-to-time need to change Eyes Pie Arts lesson schedules (eg. cancellation or rescheduling of individual lessons due to one-off projects). No less than 28 days notice will be given of any alterations.
  • The Provider will make every effort to ensure that non-Eyes Pie Arts projects are scheduled around established lesson times whenever possible.
  • The Provider will be able to show, when requested, a DBS (previously CRB) certificate which will have been renewed within the preceding three years. The Client is welcome to apply for further DBS certificates for The Provider at their own expense.
  • If you have a long term agreement with Eyes Pie Arts and wish to cease using, or reduce access to their services, please give 28 days’ notice in writing to matthew@eyespiearts.com
